BUTCHER David Hammond has been banned from driving for 12 months after failing to give a specimen of his breath.
He was arrested after police officers stopped a silver Vauxhall Vectra after they saw it screech to a halt on New Year's Day.
Prosecutor, Sabrina Naz ,yesterday told North Staffordshire Magistrates' Court that when officers spoke to Hammond, he smelt strongly of alcohol, his speech was slurred and his eyes were glazed.
"He kept falling on the officer at the rear of the police vehicle," added Miss Naz.
The court heard that officers noted Hammond was unsteady on his feet at the Northern Area Custody Facility.
Despite Hammond being given an opportunity to provide a specimen of breath, he tried to blow into the machine 13 times but was unable to complete the procedure.
Hammond, aged 36, of London Road, Stoke, pleaded guilty to failing to provide a specimen on breath for analysis.
Gary Corbett, mitigating, said Hammond did not wilfully refuse to give a specimen of breath – he was just unable to.
As well as the 12-month ban, magistrates fined Hammond �145 and ordered him to pay �85 costs and a �15 victim surcharge.
The defendant also accepted an offer to complete a drink drivers' rehabilitation course, which will see his ban reduced by three months.
